Tormach, Inc. (“Tormach”, “we” or “us”), is committed to assuring the privacy of student users (“Students”) of our educational products and services (“Services”), the teachers and administrators of educational institutions that subscribe to our Services (“Administrators”), and visitors to this website or users of PathPilot® HUB (“Websites”).  This Privacy Notice for Students supplements the information contained in Tormach, Inc.’s Privacy Policy and applies solely to all visitors, users, and others who are under 18 years old.  Protecting the privacy of Students is especially important to us. 

 

This Privacy Notice for Students sets forth our information handling practices and obligations with respect to data we gather and use in delivering Services to Students and Administrators through subscribing schools, school districts, and other educational institutions.  Tormach partners with Administrators to ensure compliance with all applicable state and federal privacy laws related to children, including the Family Educational Rights and Privacy Act, the Children's Online Privacy Protection Act, the Student Online Personal Information Protection Act, and the California Student Data Privacy Act.  Students may also access the Services by creating individual accounts on the Websites.

 

This Privacy Policy also separately describes the information that we gather from users of our Websites, how we use that information, and what we do to protect it. By visiting or using our Websites, you expressly consent to the information handling practices described in this Privacy Policy. Your use of the Website and any information you provide via the Website are subject to the terms of this Privacy Notice to Students and Tormach's general privacy policy, to the extent that it does not conflict with this Privacy Notice to Students.

 

Overview

 

Personally Identifiable Information (PII) is any information you provide to us that personally identifies you, like your name or email address, or other information which could be reasonably linked to such identifying information by us. We will only collect, use, and share your personal information in accordance with this Privacy Notice to Students.

 

We provide online services that are general audience services and do not knowingly collect personal information as defined by the Children’s Online Privacy Protection Act (“COPPA”) from children under the age of 13.  If you are a parent or guardian of a child under 13  years old and believe that we have collected such personal information, please contact us as noted below and we will take appropriate steps to delete this information from our systems.

 

What is PathPilot® and who uses it?

 

PathPilot® is our user-friendly control software for computer numerical control (CNC) machines.  Students, parents, and teachers use PathPilot® HUB as a tool to learn about CNC, machining, and fabrication.  PathPilot® HUB lets users work on real-world, machinable CNC programs when away from their machines.  Educators such as teachers and school/district administrators use Tormach products to engage and assess Students in developing programming and manufacturing skills.

 

Information We Collect

 

We do not ask for or require Students to provide personal information beyond that which is reasonably necessary to use our products and services.  Information collected from Students is never used or disclosed for third-party advertising or any kind of behaviorally-targeted advertising, and it is never sold or rented to anyone, including marketers or advertisers.  We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Student.  

 

Ownership of Content and Records

 

Students who use the Websites retain ownership of all information directly related to the Student that is generated or created by the Student's use of the Websites, including all files stored and all source code and object code generated by the Student.  Students retain possession and control of all Student-generated content through their individual accounts and may download their Student-created content created through the Websites.  If multiple Students generate content through an account created by an Administrator, a Student can transfer this content to a personal account created by the Student by downloading the content and uploading it to the Student's personal account. 

Review, Correction, and Deletion of PII

 

Parents, legal guardians, or Students who are at least 18 years old may review PII maintained by Tormach and upon request, Tormach will modify or delete the PII it maintains.  If you are a parent, legal guardian, or Administrator, you can view and/or modify Student PII through the Student's password protected Tormach account or through the Administrator's account, if the Student does not have an individual account. 

 

As a parent, teacher or school district, you have the ability to contact us at any time to review PII and categories of data being held in education records.

 

Your Tormach account may limit you from modifying certain information (e.g. the username that you use to log in to your teacher or parent account), and in these cases, we suggest contacting us, as we may be able to modify the information on your behalf.

 

You are able to request to delete your account at any time by writing to us. You are also able to request to delete your child/student's account as long as you have a parent or teacher account that is linked to that child. In this event, we will delete your and/or the Student's personal information from our systems, and will remove access from the account within 10 business days of your request. Tormach will not retain Student data and records after your account is deleted except as required by law.

Protection of Information

 

Protecting your information is important to us.  In addition to periodic staff training to ensure the security and confidentiality of Student records, we take several precautions to ensure that user information is secure.  These efforts include employment of physical, administrative, and technical safeguards based on currently available technology and practices to promote the integrity and security of Website user information we collect.  

 

While we do our best to keep your data secure, Tormach cannot guarantee the security of your data. Several factors including, but not limited to, hardware/software failure, outages, human error, attacks, or unauthorized use may compromise the security of our users' information. In the case of a data security breach, we will do our best to alert any affected users electronically via our website, the email account you have provided, and/or another medium that we deem appropriate, depending on the magnitude and severity of the breach.

 

Tormach maintains computerized data that includes personal information that Tormach does not own. Should a breach occur, Tormach will notify the account owner or, if the account owner is a Student under the age of 18, the Student's parent or legal guardian, of the breach of the security of the data immediately following discovery, if the personal information was, or is reasonably believed to have been, acquired by an unauthorized person.

 

The security breach notification will be written in plain language and will be titled "Notice of Data Breach." The breach notification will include the following information:

 

  • What happened
  • What information was involved
  • What we are doing about the breach
  • What you can do
  • Contact information

 

Use of Your Data

 

We value your privacy, and hence restrict sharing your data with third parties, with the exception of the following circumstances:

 

  • School/District Administrators- Verified school/district administrators (e.g. your student's Principal or Superintendent) who have created accounts on Tormach may be able to see your and your Students' usernames, activity, and use of the Websites.
  • Service providers- Tormach uses various vendors, partners, and service providers to help us deliver our services to our users. As a result, some of your information, including Personally Identifiable Information, may be shared with our service providers in order for them to perform their tasks. Wherever possible, we ensure that we only share the minimal amount of information for the respective service provider to perform their service. We carefully vet all of our service providers and ensure that they protect and secure your information in a way that is consistent with this Privacy Policy.
  • Analytics services- Tormach uses third-party analytics services to better understand how our users are interacting with our products and the Websites, and to improve our product over time.  In this process, some of your personal information and interactions with our products or the Websites may be collected by or shared with these analytics services in order for them to perform their service. We carefully vet all of our analytics services and ensure that they protect and secure your information in a way that is consistent with this Privacy Policy.
  • Non-personally identifiable information- Tormach may share aggregated, non-personally identifiable information with the public for marketing or other purposes.  For example, we may share data on the percentage of Students who use the Websites at home and in school in our marketing materials to parents or teachers.  None of this information will contain any Personally Identifiable Information about individual users.
  • Legal requirements- Tormach may share our users' information if we are legally obligated to do so to comply with the law. In these cases, we will disclose only the information that is deemed legally required by the applicable law, so as to protect the rights and safety of our users.
  • Change of control- In the case that Tormach is acquired or merges with a third party, your data will still be protected as per the terms outlined in this Privacy Policy.  In the case that Tormach goes out of business or files for bankruptcy, we will protect your personal information, and will not sell it to any third party.
  • Consent- Tormach reserves the right to share your or your Students' information with your explicit consent, given verbally, on paper, or electronically. For example, we may publish a case study with a teacher's name, school, district, and general information about the types of projects her Students have created using Tormach products or the Websites with her explicit consent.

 

Changes to Our Privacy Notice

 

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on the Website and update the notice’s effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.
